JIM Terms of Use

These terms apply to JIM, the fitness app made by Kobey Buhr (“I”, “me”), including its Apple Watch features, training programs, purchases, and related cloud services. By using JIM you agree to these terms and to the Apple Licensed Application End User License Agreement (the “Apple EULA”), which these terms add to. If they conflict, the Apple EULA governs with respect to Apple.

Who can use JIM

You must be at least 16 years old to use JIM. If you are under the age of majority where you live, you confirm that a parent or guardian has agreed to these terms for you.

Health and safety

JIM provides general fitness information, not medical advice. Its programs, workouts, targets, recommendations, and scores are general and are not tailored to your health, fitness level, or circumstances. JIM does not diagnose, treat, or prevent any condition.

• Talk to a doctor or qualified professional before starting any exercise or nutrition plan, especially if you have an injury, a medical condition, are pregnant, or are new to training.
• Choose exercises and loads you can perform safely with proper form, and use appropriate equipment and supervision.
• Stop immediately if you feel pain, dizziness, faintness, chest discomfort, or unusual shortness of breath, and seek medical help.

Exercise involves a risk of injury. You decide whether and how to follow any workout or program, and you voluntarily accept the risks of doing so. Results vary and are not guaranteed.

Purchases and subscriptions

Apple processes all payments. JIM+ is an auto-renewing subscription: it renews at the price shown unless you cancel at least 24 hours before the current period ends, and any free trial converts to a paid subscription unless cancelled before it ends. Manage or cancel subscriptions in your Apple Account settings. Deleting JIM or your JIM account does not cancel a subscription.

A Shop program is a one-time purchase that gives you a personal, non-transferable licence to use that program. You can restore purchases with the same Apple Account. Refunds are handled by Apple under its policies. Prices and availability may change.

Your licence and acceptable use

You may use JIM and its content for your own personal, non-commercial use. You may not copy, resell, publish, or distribute paid programs or other JIM content; reverse engineer the app except where the law allows it; interfere with JIM’s services; or use JIM to break the law.

Shared plans

If you share a plan, you confirm you have the right to share it and you give me permission to store it and show it to people who have the link. There is no tolerance for objectionable content or abusive users. Shared plans must not contain hateful, harassing, sexual, violent, dangerous, or illegal content. I may remove shared plans and restrict sharing for anyone who breaks these rules. Report a plan from the app or email the address below.

Accounts

An account is optional. If you create one, keep your login secure; you are responsible for activity on your account. You can delete your account in the app at any time, as described in the Privacy Policy.

Disclaimers and limitation of liability

To the fullest extent permitted by law, JIM is provided “as is” and “as available”, without warranties of any kind, including fitness for a particular purpose, accuracy, or uninterrupted operation. To the fullest extent permitted by law, I am not liable for any injury, loss, or damage arising from your use of JIM or from following any workout, program, or nutrition information, nor for any indirect, incidental, special, or consequential damages. My total liability for any claim relating to JIM is limited to the amount you paid for JIM purchases in the 12 months before the claim.

Nothing in these terms limits rights you have under consumer protection laws that cannot be waived, or liability that cannot legally be limited.

Changes and ending

I may update JIM and these terms. If a change is significant I will give notice in the app or on this page, and continuing to use JIM means you accept the updated terms. You can stop using JIM at any time. I may suspend access for misuse.

Governing law and contact
